Way overkill. In fact it could be problematic. I rent apartments by application. I have to have them sign a release to do a background check, so you could be opening yourself to a can of worms.
You probably don't need that release for the background check. You need it for the credit report, but a background check as the OP is talking about, is generally just a search of public records. What most people are looking for in these background checks is a criminal record. In fact most criminal records are public information, but they are also difficult to search. The FBI maintains a nation-wide database called NCIC that maintains all these records, but it is strictly controlled and can only be used for backgrounds under very controlled conditions. So since you generally can't access that nation-wide database, in order to do a complete background check you would have to check every judicial jurisdiction in every state and there are thousands of them.
