In this state, chances are you'd be cited for assured clear distance or failure to control (depending on mitigating circumstances of course)

This makes no sense. The OP was driving on the road and a jeep pulled out in front of him, so he t boned him. Why in the world would the OP be cited?
Assured clear distance is a vague concept in law, where it is even addressed in law, and mostly applies to what is in front of you in your lane, and not what enters your lane.
I think you have misunderstood the concept.
