A better solution might be for everyone to have insurance to pay for their own stuff, then there is no question of how things get paid. If the "other" guy has no insurance, tuff, it just means he has a total loss. Frankly the idea of liability insurance is nothing but a way to pad the pockets of lawyers.
As far as theft goes, what you describe is no different than someone running around without health insurance. Someone still has to pay, it just gets buried in the premiums that the rest of us, who do have health insurance, pay.
