The FAQ is for one specific OHV area, and the ARB doc is now 10 years old (and aimed specifically at labeling, not spill/vapor control).
Your points may still be valid and true, but the supporting documents are not especially strong. Thanks for adding to the discussion.

Again there is no law that exists that regulates USAGE. Yes they could get you for improper storage or transport but not usage. The laws only apply to the SALE of cans in California. Once that happened all the shops freaked out and told everyone they were illegal. Yes they're illegal to sale but not to use. - BubbaChrisExplorer

Yes they originated with CARB - as many EPA regs do.
Try to buy a new non-CARB and EPA certified generator...:(
And - any LEO (incl rangers) may cite someone (an individual) - for whatever.
He or she may not care whether it is a good or a bad cite....the
recipient can explain the "correctness" (or lack thereof) to the judge.

I do the same every time I buy a new can. If you really want to read the fine print somewhere it may be illegal. I do not care. The newer cans do not pour right and I end up spilling some all over. That is a bigger environmental impact than a few gas molecules escaping.

Thank you Chris Bryant and BubbaChris, we who live here are enjoying cleaner air because of our regulations. Some seem stupid even to me but eventually all states will have regulations like California.
I was stationed in California back in the eighties. I had numerous run ins with the local constabulary who told me I HAD to have a California drivers license, California registration, and California insurance. I was exempt from all of those requirements due to my status as an airman assigned to a southern California Air Force base. It seems the local law enforcement did not agree, I had to get the base judge advocate general (the commander's legal staff) involved. The DMV would give a different answer to the question every time, and usually with a snotty attitude, like I was a distraction from their work instead of the purpose of their work.

- mlts22ExplorerUntil I get some real NATO cans, I have found a way around the spout issue... I leave the spout facing inwards in the cap (so it is available if needed). When emptying the can, I remove the cap completely, and use a siphon pump (the type that you squeeze a bulb to prime) to get the fuel into the tank. Saves the back, especially with the five gallon containers and 100 degree temperatures.

I live in California and have never heard of any body getting cited for a gasoline container. NO ONE cares about weather you have a new style gas can or an old one. By the way, gas cans are made the same in all states.
Just because you haven't heard of it, doesn't mean it hasn't happened. I was studying up on the best style to buy/use when I bought my genny. The reviews for some models were from people who went to CA with OHV toys and were cited for their old-style cans and have now purchased spill-proof containers to be in compliance.
Most -if not all- CA OHV areas are State facilities.
Same folks (Mr. Ranger) that checks for legal exhaust *may* check fuel cans.
Good reason to have *one* cheapie plastic can for "show & tell" - and any "old style" others out of sight.
