It is. That could get what appears to be a frivolous, money grabbing suit dismissed.
It has a higher chance of being dismissed now that AG Sessions stopped the governments practice of funding special interest groups via the penalties of these law suits.
Basically, the EPA would collude with a special interest environmental group to get them and others to sue a company. Then when they win, the DOJ and EPA would order the company to pay most if not all of the fine to the special interest group essentially bank rolling more law suits and more politicians for their cause.
You are correct, and due to gag orders it can't be discussed. - ShinerBockExplorer

Not sure what that was all about. - travelnutzExplorer IIShinerBock,
Ahhh!
The 6.6 Duramax engine is NOT an Isuzu engine. It's a 6.6 Duramax engine and is 100% GM owned including all designs, patents, and sole rights to manufacture which it is and always has been in Moraine, Ohio in a GM facility. In the very beginning (1997), the Duramax diesel engine was a joint venture delevopment by GM and Isuzu. GM was the major partner (60% GM- 40% Isuzu) in the Duramax venture. However, the present Duramax 6.6 has now been 97% redesigned by GM alone and Isuzu hasn't even been in the picture for longer than decade now. Duramax was designed and developed in Moraine, Ohio in the USA!
The 6.0 and the 6.4 Ford Powerstroke Diesel of around 10 plus years ago were designed and made by Navistar for Ford but the 6.7 never was nor is.
Dodge and/or Ram never had a Chrysler Corp or FCA made or owned 5.9 or 6.7 Diesel engine as they have always been Cummins designed and produced and they were simply purchased from Cummins, shipped down to Mexico and installed in the 2500 and 3500 trucks and then the truck were imported into the USA and Canada for selling.
The EcoDiesel engine in the 1500 Ram trucks is a VMI Italy diesel engine which was initially designed and developd by GM to be a small passenger car diesel engine option and was planned to be put in a Cadillac car.

The Duramax is a General Motors diesel engine family for trucks, designed by GM and Isuzu. The 6.6-liter Duramax is produced by DMAX, a joint venture between GM and Isuzu in Moraine, Ohio.

I don't get it. Why does this always get argued about? Dodge, Ram oops....RAM, Fiat, Chrysler, all one big happy family, right? All owned by FCA (Fiat Clowncar Associates) right? :W
Are you trying to distance yourselves from the parent company?
:):)
Nope, I really don't care who owns it because truth be told many people own it if it is a publicly traded company. I am just calling it what it actually is the same way I correct those that say the Powerstroke is a Navistar engine or the Duramax is an Isuzu engine.
If you want to get your jabs in and call it something else so you can feel better about yourself then go nuts. I will still call it what it what it is, a Ram. - NRALIFRExplorer

From what I've read this is the same group that got ram in hot water for the Eco Diesel emissions scandal! As a result ram hasn't been able to sell a ED since December '16 and went from a class action to the Justice Department lawsuit.
In this particular case ram and cummins are busy suing each other like that's going to fix the problem.
Actually that is not totally the case. Ram and Cummins are suing each other on who is going to pay for it in the end, but are conintuing to work together to resolve the issue in the mean time.
"Cummins reported that while the two companies are disputing over financial responsibility of the recall, they are working “collaboratively to resolve an issue with a third party after treatment system purchased by (Fiat Chrysler) as quickly as possible on behalf of our customers,” Cummins spokesman Jon Mills said."

The case with the Ecodiesel was additional programming added to the ECM that was not disclosed at the time of certification.
