Timmac,
Hopefully you follow your own advice? After all, clearly your rig is non-compliant with its ratings. You know the old saying... people in glass houses shouldn't throw stones. Right?

You are opening whole can of worms here as law differ from state to state.
In California any trailer above 1500lb has to have brakes and break-away system. Few years back I was shopping around for equipment hauler in Nebraska and was offered brand new 7000 lb trailer with no brakes.
Chains are another story. Even trailers with heavier chains, have U-hooks on the end, who will straight up on any drop (ask me how do I know).
Bottom line, you have the right to your concerns, but bashing somebody on the internet for something you are not allow to judge can bring some legal consequences and is brushing the ethics.
I think with real concern, you should point the set to an officer.
How is pointing out a possible accident in the making is going to bring legal issues, we all learn from post like this, maybe the owner of this trailer might see this post and realize his mistake and fix the problem before somebody dies or is injured..

If we observe a DUI in progress, should we notify LE, or should we post photos on the web?

When there is nothing wrong taking a picture of poorly chosen bar, once you catch a coach on the picture or God forbid licence plate, that is whole new game.
