I wouldn't believe this one... parked car hit me!

This is long but I think the details matter.

As the title suggests I had a fender bender with a "parked" vehicle yesterday while pulling into a new campground. While making a turn the swing of the trailer caught the driver side rear quarter panel of an F250. The story gets more strange when I add that the truck was not "parked" there when I drove by!

The roads in this cg are 12' wide and curvy. The "parked" truck was coming at me from the opposite direction and made a right turn on to a side street (I assumed to proceed around that loop and out). When towing in a cg this narrow and tight I only use first gear = @2mph so I am going slow.

He turned and cleared the road.

10' past that side road was another road on my right that I needed to turn on. I had setup dead center in the street and was swinging wide due to an actually parked vehicle on the inside of this turn. Proceeded through the turn with no issues and carried on my way.

About 100 yds down I noticed a gentleman running after me... never a good sign so I stopped immediately and rolled down my window to ask whats up? He responds that you hit a parked car! Concerned, I parked and jumped out.

Looked at my driver side square steel bumper on the trailer and indeed it had hit something because the paint was scraped and the plastic stinky slinky cap was crushed in. This would be my blind side in a turn but I was sure there were no parked vehicles on that side before making the turn.

Walking back down the road he proceeds to tell me again that I hit a parked car. How could that be when there was no parked car there? As we near the parked car I see that it is the same F250 that had turned on the side road. Only now it was parked at an angle with its nose off the street and the bed sitting 2' into the road.

How did you get there? I pulled out of your way. Um no you drove into the back of my trailer. No I was parked. Was your car running? Yes. Were you behind the wheel? Yes. Did you see me making the turn? Yes. Did you see my trailer swinging? Yes. How did you end up here? I drove around you.

Exasperating I know because I was looking for the "gotcha" camera crew by now. By the way his bed side is totalled those steel bumpers are seriously tough.

So you pulled around me and out of my view and parked with your truck in the street where I will swing making the turn? You then sit there and make no effort to go forward or back nor honk your horn? You then admit you watched the whole thing happen and decide somehow I am at fault?

So yes I was hit by a "parked" car yesterday. The driver is from Montreal and waited for the Sheriff to show up for a police report. He told him the same story, the Sheriff asked me mine, and asked if I would be filing a claim for damage to my trailer :). No I think I can cover the $2 cap :). Amazingly the guy in the F250 continued to believe he was completely in the right.

Actually you were both at fault. There is no such thing as an "accident" unless while you are driving down the road a tree limb falls and hits your vehicle. You did not experience an "accident" you experienced a "crash".

If after he cleared your TV on such a narrow road should you have maybe stopped to make sure he made it all the way past your trailer? YES

If when he was trying to drive around you on a narrow 12' road should he have pulled more out of the way or started sounding his horn? YES

Showing pictures of the incident to others is not going to effect the outcome of any settlement one way or the other. If it did TV cameras would be outlawed. ๐Ÿ™‚

EDIT If it happened in a private campground, I'm surprised tha a sheriff even took a report. If there were no injuries, a lot of times they won't even get involved.

That really sucks. It never ceases to amaze me in campgrounds how few people are really on the ball and can predict the movements that truck/trailer combos are going to make, and make adequate room for someone accordingly. I've noticed a real lack of courtesy at times when trying to back in as well.

If you have taken photos and a statement to your insurance agent that is likely all you can do.

Glad I have hit the good natured bunch... responses to a few questions:

Yes already gave statement to my insurance.

The other driver was very polite and we had good conversation. He even admitted that his truck is very big for him to drive. I let him tell his own story to the Sheriff, it supports my entire argument.

I didn't post pics because of a few reasons #1 until things settle out it would be a bit premature (never know how far this goes) #2 I only shot video. Stills don't capture the depth and placement well. To the poster who doesn't believe my story you should follow your logic train... it jumped the track.

Regarding "you hit him you are at fault" that is a simplification that assumes 1.his vehicle was indeed parked 2.I had awareness and sight line; if a big rig is making a turn and you race up inside and get hit by the trailer that is your fault. Another example; you are driving down a street at 45mph and a vehicle pulls out right in front of you and you hit them. Your argument dictates it is your fault. Its not your fault when someone does something stupid.

Yea, you are all taking it too serious. I think you missed the humor. Slippery ... in the fact the truck was at one road then slipped into another road. "one on every corner" ... well, in this case, it was the same one! Still, he was there at both corners ... :B Big grin.... don't take it so serious!

This is why I have a dash cam. In this case it would show that the truck was not there as you approached. Then a cell phone picture of the truck 2' into the road would back up your case.
It never amazes me how others will act around a trailer in tow. Tailgate through the campground, then act surprised when you stop and want to back into a site!! :S

Without pictures it's just a tall tale. Everyone's phone is a camera. If he was2 feet into the road, you should have a picture.

Hi,

You should still call your insurance agent. It seems like this guy is going to call his agent, and then put in a claim. This will go back on your insurance, as they will surely blame you and your trailer for making contact.

If you do not ocntact your agent within a certain time, they will say "We no longer need to pay, because you never told us about the potential claim" But if you do contact them, you do not have a fault accident, unless it turns out that way. And a replacement pickup bed, and it's paint job can run well over $2,000. You do not want to be stuck with that bill.

I have met camping folks from Canada, here in the States, all good people, the kind I like to have next to me!

I have traveled, and camped in Canada, and found the same. I remember crossing the border, the Canadians were friendly, treated me well. The American guards, not so much!
