Another CW BAD!

Had to get something out of our rig that has been waiting in line for a month to get fixed. Employee walked us out and opened the door. What you don't lock them? Nope he said. Over two hundred and fifty customer rigs in the lot waiting for service and none locked! Must have signed several pages of CW not responsible documents when we checked in. Hell of a way to run a business.

You seem to be a fairly savvy person; why is it that you continue to ignore the fact that an action taken in State court will NOT rely on "the body of case law" in any other state.

Therefore there ARE 50 different sets of case law that might apply depending on what state you are in. And what parts of that body of case law are applicable depends on the specific circumstances.

While your assumptions might be true in a lot of cases, they still are assumptions.

Well actually I do. Not all agreements are adjudicated by written "Law". In fact most are not.

Most judgements are based of precedents of previous similar judgements on cases that share a COMMON issue. Most judgements are based on these as no Written laws apply specifically to every circumstance. Secondly most legislatures shy away from writing such specific laws.

So in fact there are not 50 sets of RULES as you call them. there is instead a body of case Law that is relied upon by judges and lawyers to argue their cases and find for or against a given plaintiff.

On a case like this settlement is almost assured as the cost of litigation to the RV dealer and the, at least, 50-50 chance that he will be saddled with court costs and lawyers fees just doesnt make it a smart move to take to court.

In fact my bet is the corporate counsel for the RV dealer would be remiss in his legal and ethical obligation if he did not sternly warn the RV dealer that there was no case on his part and that a settlement, sooner rather than later, was in his best interests.

In most cases, that is true ONLY if the dealer was somehow negligent.
It may take a jury to define "negligent" in each individual case.


I think not. If it is on the dealers lot under his protection and at his request or insistence he is definitely liable for damages. Period. And I can tell you no case will get to court as the dealer will settle it well before hand.

Hi OP here: Just for grins thought I would show how I can keep track of
where my RV is. Helps me understand when CW is actually doing something. My GPS tracking system works something like Lojack only a lot better. Can't show the map included with report but it spots location of RV within + or - 20 feet. Heartbeat is daily system check and location report and plug in report tells me batteries were dead and rig was connected to shore power. Pretty cool stuff.

I have taken my motorhomes to Holland Motor Homes for years and when they are in their lot they are locked. The entire lot is also fenced and locked when they are closed. Customers get to dump free in their dump station also. Since it is only a mile from my home I use it regularly.

I would almost bet Thor did not send wrong part if any part. Sounds like they are just making excuse to put you off.
Thor was very responsive to our request for info. After I figured out both parts ORDERED wrong by CW - I can only conclude CW tech has never replaced cable on slide. Have decided to go pick it up and take it elsewhere.

I am not saying that I am taking my car to an rv shop for repairs, I am taking it there at the suggestion of the body shop so that I can get an estimate in writing on parts and labor to replace the tow bar, so that he can send that along with his body repair estimate to the adjuster.
